Legacy Farm and Cattle Co. 2025 Garden Share Subscription Box/CSA Contract Agreement, Terms and Conditions

This Community Supported Agriculture (“CSA”) Agreement governs the term and conditions of the relationship between Legacy Farm and Cattle Co. LLC  (the “Farmer”) and the CSA Member/Garden Shareholder (“Member”). 


By becoming a Member of the CSA, you enable the Farmer to prepare the land; plant, raise and care for all of the crops; and harvest them in due course during the season. As a Member, you will also secure your Share at the current market rate.


This CSA program is only available to a limited number of Members. The Farmer reserves the right to set the number of Members based on the projected harvest size. Legacy Farm and Cattle Co. reserves the right to reject any application for any reason.


By submitting an application and paying the Share price ahead of time, you agree to become a Member of the Garden Share Subscription/CSA program. Once paying your fee, you will not be charged any additional fees unless otherwise stated in this agreement. You will, however, have the option to purchase additional items from Legacy Farm and Cattle Co. during the season for their applicable prices at that time.


The goal (not commitment) of Legacy Farm and Cattle Co and the CSA/Share program is to provide 14 weeks of produce, or Shares, to the Members.


  1. Length or Agreement: This CSA/Share program will run for approximately 14 weeks in a normal season, weather permitting there may be more, or less. The season is anticipated to begin around June 16th/23rd 2024, weather permitting. The Member understands that the CSA program start and end date will be determined by several factors including the weather and growing conditions. Therefore, the Farmer cannot precisely determine the start and end dates of the Shares. Members will be notified at least one week prior to the start of the Shares availability.

  2. Definition of Share and Price: A “Share” will be a fair amount of vegetable and/or fruits per share the member supports. The cost of a 2025 season Full Share Farmers Choice is $600.00. Half Share Farmers Choice is $400.00. A $50.00 discount will be given to members opting to pick up their share at the farm or a farmers market the farmer attends. A $50.00 early bird discount may be given to any member paying in full on or before December 1, 2024. Members will only receive one of the discounts listed above.

  3. Delivery-Pick Up: The Farmer is responsible for delivering the weekly garden box to the Members porch of the specified address in Genesee, Lapeer, St. Clair, Tuscola, Oakland, and Saginaw counties on designated days (schedule will be released once registration closes, however, delivery days will be Mon-Wed)  unless otherwise specified at least 3 days in advance.  If the member needs to change the delivery address, the Farmer requests 7 days notice. If the Member is opting to pick up their box, they are responsible for picking up their box on the day and time selected during registration.  Note: Day and/or Time may change as we approach the season. We will do our best to stay consistent. Any change in delivery or pick up availability will be communicated at least 24 hours in advance.

  4. Farmer Responsibilities:

    1. To work dutifully, diligently, and in good faith to bring the Member the freshest produce possible during the season.

    2. To have produce washed* and packaged for easy transport. *Field washing is only meant to remove dirt from the garden due to the nature of growing food. Produce will still need to be washed before consumption.

    3. To have shares available and/or delivered at the date and time specified.

    4. To notify Members if there is any change in Share delivery time or place.

    5. To communicate with Members about weather problems, crop failures, and/or any other factors that may impact the contents of the Share box.


  1. Member Responsibilities:

    1. To pick up your Share at the agreed time and date. If you can’t pick up your Share, you may have someone else pick up your Share for you. We do require that you send us notification in advance. You may also choose to have your box donated in the event it cannot be picked up. If you, or someone you designate, does not pick up your Share, it will be considered forfeited and become property of the Farmer and no refunds will be given. The Farmer will attempt to hold it for 24 hours but will not guarantee freshness or quality of items.

    2. To return Share boxes each week for reuse by the Farmer. Failure to return boxes will result in a $5 missing box fee.

    3. To handle your produce responsibly and safely. This includes, but is not limited to, final washing before consumption, refrigeration, cooking, etc. It also includes educating yourself on proper ways to clean, eat, and/or cook.

    4. To read, understand, and agree to this document in full upon submitting an application for membership share.

  2. Refunds and Cancellations:

    1. Member’s Policy: A member may cancel their Share at any time. Cancellation requests must be in writing via email or USPS. Refunds will be as follows:

      1. Prior to January 1, 2025 100% refund.

      2. Between January 1, 2025 and February 28, 2025 50% refund.

      3. After March 1, 2024 no refunds will be given.

    2. Farmer’s Policy: At the Farmer’s discretion, the Farmer may cancel this Agreement at any time for Member’s failure to follow their responsibilities as stated in the Agreement. In the event of cancellation by the Famer, Farmer reserves the right to decide whether to refund any prorated share of Member’s fees. Member’s will be notified in writing of the reasons for the cancellations.

    3. The Share Agreement is transferable in the event the Member is not able to continue to receive their Shares. Request for transfer is required and a new Agreement must be signed prior to completion of transfer.

  3. Risk:  In a CSA, Members are supporting their Farmer. To do so, Members share the risks inherent in agriculture. Risks included, but are not limited to, poor weather, drought, flood, early/late frosts, diseases, insect problems, and crop failure. They also share the rewards such as an abundant production. Members assume the risk should the Farmer be unable to provide a share, whether in part or in full, due to any inherent risk in farming and agriculture.

All of our customer information is kept confidential. We do not sell or make our email addresses or mailing addresses available to any other parties or companies.

  5. Payment:  

    1. Member MUST pay their total payment upon submitting their application to secure a Share. 

    2. Members wishing to set up a payment plan may contact us via email stephanie@legacyfarmandcattle.com to discuss option. Share is not guaranteed until full payment is received and no refunds given on partial payments. Payment plan fee of 5% will apply.

    3. Payment may be made by check, cash, or credit card (3% fee applies)

  6. Acceptance of Agreement:

    1. By signing this Agreement, the Member hereby releases, indemnifies and agrees to hold harmless the Farm and/or property owners, its agents and employees from any and all claims and/or liability from being on the Farm property, being at any of the CSA pick up locations and markets, from the purchase of a CSA membership or the use or consumption of food provided by the Farm.  By submitting the online or paper form, confirming via email, phone (call or text) or in person, you are agreeing to accept all parts of this Agreement in its entirety.
